Commission on Public Integrity Issues Two Advisory Opinions

ALBANY — The New York State Commission on Public Integrity today released two advisory opinions. One deals with the post-employment restrictions in the law and the other involves the use of frequent flier miles and other travel incentives by State employees.
In Advisory Opinion No. 08-03, the Commission determined that an employee of the New York State Thruway Authority, who is anticipating retirement, may not be employed on a Thruway Authority project whose contract will be awarded within two years of his departure from State service since the consultant for whom he anticipates working must submit the employee’s name and credentials to the Thruway Authority for prior approval as part of its bid.
In Advisory Opinion No. 08-04, the Commission determined that State officials or employees traveling on State business may be allowed to use, for their personal benefit, reward or bonus points offered to customers by common carriers and hotels. However, State employees whose job requires them to purchase supplies and services for their State agency are prohibited from personally accumulating reward points resulting from such purchases.
